These Terms & Conditions ("Terms") govern your use of Tiny Whabbit (the "Service"), a heritage-language habit app for families. The Service is operated by Omowunmi Kolawole, trading as Tiny Whabbit ("we", "us", "our"). By using the Service, you are entering into an agreement with Omowunmi Kolawole.

1. Acceptance of these Terms

By creating an account, accessing, or otherwise using Tiny Whabbit, you agree to be bound by these Terms. If you do not agree, please do not use the Service. Your continued use of the Service after we update these Terms constitutes acceptance of the updated Terms.

2. Who can use the Service

You confirm that you are of legal age in your country to enter into a contract, or that you are using the Service with the consent of a parent or guardian. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

3. The Service

Tiny Whabbit helps parents and caregivers build a daily habit of speaking a heritage language with their children, through short prompts ("tiny moments") embedded in everyday routines. The Service is provided on a free-to-use basis, with optional pay-what-you-can support contributions.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • use the Service for any unlawful, fraudulent, or harmful purpose;
  • send spam, attempt phishing, or impersonate any person;
  • infringe the intellectual-property rights of Omowunmi Kolawole or any third party;
  • attempt to interfere with the security or integrity of the Service — including by introducing malware, probing for vulnerabilities, scraping content at scale, or circumventing technical limits;
  • reverse engineer, decompile, or resell the Service.

5. Account credentials and accuracy

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Please provide accurate information and keep it up to date.

6. Intellectual property

Tiny Whabbit and all of its content — including software, text, prompts, designs, branding, and the "Tiny Whabbit" name — are owned by Omowunmi Kolawole or licensed to her. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use. Nothing in these Terms transfers any intellectual-property rights to you.

7. User content

You retain ownership of any content you submit (such as your child's name or notes you save). By submitting content you grant us a limited licence to host and process that content solely to provide the Service to you.

8. Service availability

We work hard to keep Tiny Whabbit available, but we do not guarantee uninterrupted, timely, secure, or error-free operation. The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including those of merchantability and fitness for a particular purpose.

9. Payments and Merchant of Record

Tiny Whabbit is free to use. We also offer optional pay-what-you-can support contributions and (in future) paid features.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, cancellations, and refund mechanics are governed by the Paddle Buyer Terms. Please also see our Refund Policy.

10. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay any amounts due, create a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. On termination, provisions of these Terms that by their nature should survive will continue to apply (including sections on intellectual property, liability, and governing law).

11. Limitation of liability

To the fullest extent permitted by law, Omowunmi Kolawole's total aggregate liability arising out of or in connection with the Service will not exceed the greater of the amount you paid us in the 12 months before the claim arose, or US $50. We will not be liable for any indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law (including for fraud, death, or personal injury caused by negligence).

12. Indemnity

You agree to indemnify and hold Omowunmi Kolawole harmless from any third-party claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

13. Force majeure

We are not responsible for failures or delays caused by events beyond our reasonable control, including natural disasters, internet outages, labour disputes, or government action.

14. Changes to the Service or these Terms

We may modify the Service or update these Terms from time to time. If the changes are material, we will provide reasonable notice (for example, in-app or by email). Your continued use of the Service after the effective date constitutes acceptance.

15. Governing law

These Terms are governed by the laws applicable at the place of residence of Omowunmi Kolawole, without regard to its conflict-of-law rules. The courts at that place will have non-exclusive jurisdiction over any disputes, subject to any mandatory consumer-protection rights you have under your local law.

16. Assignment

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
